On August 4, 2026, the California Public Utilities Commission current agenda listed Item 11, Agenda ID 24294, concerning Resolution ST-272. The adopted resolution, dated July 16, 2026, grants the Orange County Transportation Authority a variance from General Order 95, section III, table 1, case 8, column B, and section VIII, rule 84.4-D4, for three additional overhead catenary system pole locations: 1W/118, 1W/128, and 4/008. A recent California utility-safety order offers a useful lesson for anyone who manages trees near overhead facilities: a clearance variance is not permission to stop measuring. It is a documented control program that must remain effective as field conditions change.
In Resolution ST-272, the California Public Utilities Commission authorized OCTA to place three overhead catenary poles closer to existing communication lines than General Order 95 ordinarily permits. The resolution records unmitigated clearances of 21 inches, 16 inches, and 4 inches against a 22.5-inch requirement, then accepts a nonconductive protective sleeve, written utility concurrence, and continuing inspection obligations as the mitigation package. Id. at 2-6. The order also provides that the variance no longer applies if a communication company replaces or adds cable at the listed location, and it requires OCTA to continue complying with General Order 95, rule 31.4, which addresses cooperation to avoid conflicts. Id. at 7.
General Order 95 is a California Commission regulation governing overhead electric and communication facilities. It is binding within its scope. Resolution ST-272 is likewise binding as an agency order, but only for OCTA, the identified facilities, and the conditions stated in that order; it is not statewide judicial precedent and it does not amend General Order 95 for other owners. The arboricultural parallel is direct. Tree growth, regrowth after pruning, wind movement, conductor sag, and changes in access can alter a clearance envelope after an inspection. A vegetation-management file that documents only the initial cut, without the target clearance, responsible party, inspection interval, and trigger for reinspection, is weaker than the conditional approach reflected in ST-272. The resolution does not decide negligence, tree damages, or compliance with Public Resources Code sections 4292 and 4293. It does, however, show how a California regulator evaluates an exception: identify the precise conflict, test feasible alternatives, obtain affected-party concurrence, specify the mitigation, and preserve a mechanism for verification.
For counsel and arborists, the practical point is modest but important. A variance, pruning prescription, or line-clearance agreement should be drafted so that a later change in vegetation, equipment, ownership, or utility configuration automatically prompts review. That is not bureaucracy. It is how an operational exception remains defensible evidence of care.
